2025 Dates of Need for H-2B DRIVER will be 5/15/2025 to 12/20/2025C & R Asphalt LLC. is a family owned and operated Asphalt Contractor which provides total paving solutions for both commercial and residential clients. C & R Asphalt LLC. is involved in the commercial and residential pavement resurfacing business in Lexington KY.C & R Asphalt LLC. provides paving and sealcoating solutions from concept to completion. We provide asphalt road construction, parking lot repair and resurfacing and asphalt walking trails. This is peakload outdoor work in which the majority of the work (but not all) which is generally performed from spring through subsequent fall. We have been in business since 1998. Our peakload date of need is regularly recurring annual business cycle customary to the paving industry in our geographic area. This is peak load outdoor work which is performed year round with a peak period from 5/15/2025 to 12/20/2025.Temporary NeedTo assist in the determination of whether our companys need is consistent with USCIS definition of temporary need, we are including the following information: Work Duties will be consistent with those stated on the USDOL ETA Form 9142B and the USCIS I 129 Petition for Nonimmigrant Worker. These duties are evidenced in our 2024 contracts.Our Peak-load period for the driver position is a Peak within a Peak period. Our normal peakload period for construction laborers begins on 4/1 of any given year, and the peak for drivers begins 6 weeks later. For the first 30-45 days our workers are cleaning and preparing sites, and cleaning up rubble, debris, and other waste materials. Major asphalt season begins on 5/15 (our peak within a peak period) of any given year and so we have an increased need for drivers as the projects require more equipment including earth tampers and cement mixers, and there is more rubble, debris, and other waste materials to be hauled to and from the job sites. Duties requested workers would be performing are consistent with those described in the US Department of Labor ETA Form 9141 Prevailing Wage Determination SOC 53-3033 for Drivers.Based on the careful analysis described later in this document, our need for 19 temporary H-2B workers is fully supported by our companys projected workload for the 2025 season, and our workload analysis substantiates the need for the requested workers throughout the entire period of proposed employment, i.e., 5/15/2025 through 12/20/2025 at stated hourly wage and number of hours each week. OperationsThe asphalt process begins with surveying and excavation. Workers perform tasks involving physical labor at construction sites that may include: operating hand and power tools such as air hammers, earth tampers, cement mixers, small mechanical hoists, surveying and measuring equipment, and a variety of other equipment and instruments; clean and prepare sites; dig trenches; set braces to support the sides of excavations; erect scaffolding; clean up rubble, debris, and other waste materials; and assist other craft workers. Once the first 6 weeks of spring clean up and preparation are completed, an increased need for drivers begins. Projects requiring the delivery of cement, equipment, as well as construction goods such as pavers and loose stone increase once the job site is prepared for the new construction. Drivers will drive a light vehicle, such as a truck or van, with a capacity of less than 26,001 pounds Gross Vehicle Weight (GVW), and may load and unload vehicle.In order for our company to meet its contractual demands, we need to supplement our workforce during this peak demand. In the fall, construction slows down. In the colder months, very little new construction begins, and we no longer require the H-2B workers, and our permanent workforce is able to manage the drastically reduced customer demand.We are submitting laborer payroll.
